Good evening, Salem.

A federal judge on Monday will hear final legal arguments over whether he should drop a criminal charge against a U.S. DEA agent who ran a stop sign and fatally collided with a cyclist in Salem.

The criminal case has centered around whether Samuel T. Landis, 39, should be immune from prosecution because he was exercising his duties as a federal agent pursuing a suspected drug trafficker when he ran the stop sign. The collision killed Marganne Allen, who was on her way home from work on March 28, 2023.

The oral argument is scheduled to start Monday morning and could continue into Tuesday morning. Eugene U.S. District Judge Michael McShane could rule from the bench or take additional time to consider the arguments before making a decision.

We’ll be attending the proceedings in the Wayne L. Morse U.S. Courthouse in Eugene and will keep you updated on the results.

Meantime, here is our most recent reporting on where the case stands.
